Yup. The ruling elite are doing everything they can to divide you. They are doing everything they can to promote hate between you.

In this article, I argue that the real enemy is the ruling elite, which manipulates us all. I explain that the Western USA-based ruling elite is desperate these days, and exceptionally adversarial, which is driven by the successful rise of Eurasia (economically led by China, and supported by Russia), and by increased global abundance of extractable energy reserves. We allow ourselves to be collateral idiots and pawns in this saga.

The ruling elite and the captured media want you to be convinced that their oppression of everyone comes from either a tsunami of irrational “socialism” or spontaneous upsurges of “fascism”; that fascist cells are nucleating and growing at an unprecedented rate, and that you and all your immigrant, brown, black, LGBTQ compatriots will be deported or imprisoned or deprived of medical attention, if the said cells are not deplatformed, censored, run out of town, punched in the face, and exterminated.

Actually, no, that is not true.

The ruling elite in the USA, and in the Western world, by projection, are comprised of two opposing and collaborating factions: The “Democrats” and the “Republicans”, which represent different and overlapping blocs of the Western ruling elite.[1][2][3][4]

Both blocs or networks agree to use military force and covert means to exploit and extort, in the world that they consider their plantation. Both networks use their influence to constantly transform national and global rules to their advantage, to the point even of literally writing the laws, and to the brink of destabilizing the USA domestic society itself,[5] and the global economic and strategic balance.

The ruling elite (acting together, consistently and deeply) manipulate, socially engineer, and exploit the rest of us, to different qualities and degrees, depending on social class. The main mechanism is to divide to conquer. The divisions are first along class lines, and, within classes, along cultural, race, religion, and gender lines.

Democracy is a constant threat to the ruling elite. Therefore, democracy must be constrained to a manageable form, and crushed wherever it actually emerges. The remnants of electoral democracy are used in more-or-less a show-competition between the two opposing networks, which serves them both by floating the illusion of popular participation and by dividing the public.

The “Democrats” are tied to global finance and push for a global carbon economy, and global “development”, in the image of their malicious interest. Their deep-state base is the CIA and they excel in media and entertainment-industry control.

The “Republicans” are more tied to the USA domestic-energy sector (such as the exploded shale-oil economy), to the army, and to the armament industry. They are more nationalist in their power centre, more into the extraction and wage-slave-production industries in Latin America and Africa, via USA corporations, and have less use for the UN in their manipulations.

Both ruling-elite networks have collaborated together since the end of the Second World War, with the deep state, to establish and maintain the USA dollar as the global currency, which is their most potent weapon of global exploitation, and now overt extortion, backed by violent military interventions, campaigns of economic devastation, and covert coups and proxy wars.[6][7]

Fast-forward to today: Two global tectonic shifts have and are occurring, which fundamentally threaten the USA/Western ruling elite, in that USA hegemony itself is challenged.

The first global tectonic shift is the continuous rise of Eurasia, economically led by China, with strategic, diplomatic and organizational support from Russia. This coincides with Russian emergence in protecting its national interests in Syria and Venezuela, while offering military technology (S-400 air-defence missile system) that neutralizes USA air dominance, to Turkey and others.

The second global tectonic shift is the increased global abundance of easily extractable fossil-fuel reserves. It turns out that shale-oil is everywhere, as is natural gas; and Chinese coal, not counting secure imports,[8] is plentiful enough to power China, using modern centralized generation and transformation stations, for decades. There is oil and gas in Venezuela, Russia, Syria, Iran… Canada, USA… more places than can easily be controlled to starve competitors, to ensure high prices for preferred producers, and to keep the petro-dollar alive.[6]

These global tectonic shifts divide the ruling elite, as they scramble to settle and impose a response strategy, and as their differing economic interests collide.

The globalist “Democrats” want an enforced carbon economy (to save humanity) and a crypto-currency that they control,[9] and, in their daydream, want to include Eurasia, the whole shebang. They don’t want all-out trade wars that drive Eurasian exclusionary integration. They prefer covert power rather than military campaigns, and prefer to preserve the UN as a tool.

They are content to deprive their ruling-elite adversaries of oil-supremacy if they can keep finance supremacy, enforced by military might as needed. They are habituated to occupation by social engineering, and hope for an entire world woke to climate change, public health by vaccination, life-extension by big-pharma, food abundance by GMOs and glyphosate, and human rights by gender-reassignment medical and pharmaceutical procedures, “anti-racism” and “gender equity”.[6][7]

The nationalist “Republicans” want to control oil by force, using blockades, sanctions, and military occupation (Russia, Iran, Syria, Venezuela, even Canada in a pipeline-propaganda war[10]), sell USA oil at top dollar (with an emphasis on “dollar”), save the USA-dollar-as-world-currency gravy train, and extort military-protection rent and arms sales from its “allies”, while making Eurasia enemy number one.

In a nutshell, the governing elite are running a vast and violent exploitation and extortion racket that is now in decline in the world. The decline is putting tremendous pressure on the scheme, and the elite are desperately lashing out to slow or reverse the inevitable. Their disagreements are more urgent than ever, and they are willing to have unprecedented adversarial battles in the open, and to use us all as triggered or engaged idiots.

“White supremacists” are just ordinary folks sick of being manipulated and cheated by the ruling elite. “Black bloc” anarchists are ordinary youth sick of being brushed aside and made irrelevant by the ruling elite. Both need to see the strings and stop looking for schoolyard fights. Our best friends need to be all those harmed by the same elite manipulators. Our worst immediate enemies are the collaborators. We need to treat words as words, and stop looking to punish our compatriots. The enemy of my enemy is my friend, and the “white supremacists” are thereby eminently your friends.

Free-speech enthusiasts are right of course but they need to see those wanting false protection from censorship as merely misguided targets of the common enemy. It is the enemy that is implementing the censorship, not snowflakes. The elite will censor using any pretext. Woke automatons are just proof of the broad destructive power of social engineering. Woke automatons are not the enemy of the Right: Ignore them, insult them if this has civil-jolt value, but focus on the real enemy. The real enemy determines school curricula, writes laws, attacks democracy, censors speech, funds everything, and campaigns for war.

Social Animals have Two Modes of Being

I want to describe what I think is a fundamental truth about the individual bio-psychology of social animals, including humans.

Setting for the model

The setting for my model is arguably the greatest current scientific revolution: The formal realization and empirical demonstration that virtually all of social behaviour and individual psychology is encased in the evolutionary, biological and metabolic reality of dominance hierarchy.

For example, see Sapolsky’s influential 2005 review of primate studies [1], and my critical review of medicine [2]. The metabolism of the monoamine neurotransmitter serotonin and the associated evolutionary biology is now an established area of science [3][4][5][6]. In my opinion, the said area of science, although far from complete, constitutes a foundational building block of the new tectonic-plate theory of social science, whether social scientists are aware of it yet or not. And it has started to infuse the popular culture [7].

This knowledge implies that the metabolic biochemistry of dominance locks us in. No socialism theory that presumes altruistic cooperation as its organizing principle can ever work. Non-hierarchical anarchism and its libertarian cousin are useful conceptual end-points that can never be sustainably achieved. The best we can do is to have a responsive and optimally (evolutionarily) beneficial dominance hierarchy that is actively prevented from exercising pathological excess [8].

The model

In this setting, I propose that the animal has two modes of being, which are binary end-points on an attitudinal, self-image and behavioural psychological-state-scape.

I’m not saying that each individual is permanently in one or the other mode of being. Rather, I propose that the individual shifts and slides into one or the other mode depending on his immediate social circumstances and on his history (biological and metabolic memory) of being predominantly in one mode or the other.

The modes of being that I propose map onto the social dominance hierarchy, and are consistent with the roles of different individuals within the hierarchy.

Specifically, one mode is the mode (and strategy) adopted by the dominated individual. This mode is one were the individual seeks “fairness” and minimal aggressions in their environment. The individual seeks a “safe space” and has no actual design to displace dominants. The culture of individuals that coalesce into such a stratum of the hierarchy is one where “kindness” and “being a good person” are the highest social values that are encouraged and rewarded. Altruism and “goodiness” are elevated to a status meriting religious indulgences. Viciousness actuated by enforcers within the social stratum is turned towards violators of this code.

The other mode is the mode (and strategy) adopted by the individual who intends to be and to remain dominant. It is an outlook of waging and winning battles for dominance. This is the climber with a “killer’s instinct”, prepared to joust for relative advantage and eager to dominate.

These modes are distinct mental and physiological states of being. They occur inside the individual and cannot always be ascertained reliably from outside indicators. For example, climbers in a corporate or government office hierarchy may achieve success by “kissing ass” rather than by confronting superiors. Advancement in these institutions may arise from actuation of the goodiness mode rather than the competitive mode, or competition within an office level may be the selector used by superiors. Anything is possible in a given corporate enterprise, in terms of utilization of intrinsic human behaviours.

The two distinct modes are real regarding the individual’s experience and bodily biochemistry, in the circumstances, rather than ascertainable from superficial outside features such as house or car or ring size.

The psychological-state-scape is binary in the two modes because the metabolic physiologies of the two modes are incompatible. The holistic state of being cannot be both simultaneously. Different blood biochemistries and tissue and organ responses are in play. It’s one or the other: Vying for dominance or accepting subservience. Fight or flight. Challenge or hide. More than a billion years of evolution ain’t goin anywhere.

“Bosses” will find each other to fight. Subservient individuals, subservient in the circumstances, will lower their eyes, group to the edges of the room and exchange vital information about who is “a nice person”.

Application to politics

The establishment bosses that run the Left, more than the Right, exploit the population of individuals that are most easily corralled into the goodiness mode and seduced by goodiness promises.

The boss propaganda (mainstream media, institutional messaging) is clearly designed in this direction: human rights, minority rights, environmentalism, democracy, participation… whereas the state continues its vicious wars of dominance world-wide and its violent apartheid of aboriginal and low economic classes and of non-violent Criminal Code offenders.

It is a textbook illustration. Extreme social justice warriorism and safe-space obsessionism are, in my opinion, pathological and predictable outcomes of unchecked exploitation by those who ride the Left.

As a backlash against the overly successful establishment Left propaganda and institutional capture, individuals who are inhabited by the competition mode react in revolt by violating the goodiness rules of expression and behaviour, causing generalized and amplified outrage. They break the taboos, express racism, use the N-word, graffiti swastikas, speak their minds, and trigger and troll the masses.

The establishment bosses that run the Right have not been keen to use this relatively unmanageable population and have been only tentative in exploring how to use it. Trump changed that. There is no denying that Trump unsettled traditional Republican forces.

This does not mean that all Right-thinking voters are competition-mode individuals, not by any stretch. Most Right-thinking voters are conservatives who seek the “safe space” of traditional family and religious values. They are horrified at the prospect of an eroded institutional framework that could threaten this safe space and they seek the good-person representatives that would protect them.

The establishment bosses that exploit both the Left and the Right understand that goodiness is a winning electoral formula, since most individuals in a dominance hierarchy are goodiness-mode followers rather that competition-mode individuals who vie for higher echelons. This is the nature of a stable dominance hierarchy: Most people just want to be oppressed fairly, to know their place and to be safe. In a so-called “democracy”, since show elections are required, the only question is the flavour of the goodiness.

A problem arises when the flavours of goodiness are so different that the other side is threatened when institutions are captured. Then many will feel they are in danger and the conditions are ripe for competition-mode redress.

In these circumstances, the Right voters shift to seeking and supporting competition-mode leaders that will fight back on their behalf, and more of the Right adopts a competition-style stance. It could have gone the other way, like it did for decades. The Right could have accepted defeat, accepted the humiliation of being “bad persons”, and sought refuge in their own spaces. The Right could have stayed in a social state with most of its individuals in the goodiness mode being pampered by goodiness-mode representatives promising elusive “justice”.

In Canada, I think Preston Manning was a goodiness organizer (reform by rational argument) whereas Harper organized a coup and dismantled as much Left capture of institutions as possible. The Left stuck with goodiness and turned it on, screaming about the Right’s demolition of “human rights”, “environmental protection” and “democracy”. We got Trudeau. Now the Right is rightly pointing to some of the pathologies of going too far with Left goodiness, and its managers are exaggerating the institutional threats against family and against human nature itself, no less.

So goes the seesaw of political manipulation, perfectly in resonance with the intrinsic modes of being of the individual. The individuals naturally self-organize and are corralled into protective communities, both within and between strata of the hierarchy.

Application to religion

Institutionally organized religion is a perfected system of goodiness rules, which stabilizes and strengthens a dominance hierarchy. Even environmentalism can be understood as such a state religion [9].

Religious belief and practice, for most people, is deeply ingrained in the goodiness mode of being of the individual, as should be obvious from my above description. The rituals of recycling, healthy lifestyle practice, donations to The United Way and so on, while they have no positive effect on population health, systemic negative class bias or “the planet”, nurture and solidify a prolonged and robust adoption by the individual of the goodiness mode of being.

As long as a majority of citizens reside in the goodiness mode of being, the dominance hierarchy cannot be challenge and major displacements will not occur. Public peace will prevail.

Of course religious seminal texts, nowadays including much of the so-called scientific literature, are more complex than state propaganda and can be used, as needed or desired, to incite individuals into the competitive mode of being, into the confrontational state, to be manipulated by political organizations.

This is actively seen today in Zionist Israel with Torah and holocaust scholarship, where the texts are used to incite and rationalize genocidal displacement, confinement and suppression of the native population. Interestingly, hard science (genetics) has established that white European Jews that have always run the modern state of Israel do not have a relevant ancestry that originated in Palestine.[10] If science mattered.

Conclusion and verification

It is in our animal and human nature — inherited on our evolutionary path — to occupy either the goodiness or competitive modes of being, which represent biochemical and physiological states of either accepting or challenging the dominance of others.

The reality of my model of individual modes of being can be tested (experienced) by experimentation with LSD, which alters serotonin metabolism.[11] A common description of mild LSD experiences is that the subject is able to escape their persona and become conscious of their identity programing and conscious of the identity or motivational programming of others.[12] Dominance hierarchy is dissolved by blocking serotonin receptors on neurons. No wonder that’s illegal.

Pernicious effects of political correctness

The presumed harmful effects against people of both state surveillance and political correctness are of the same character. 

Most Liberals opposes surveillance but participate in political correctness. Many Conservatives reject both, which is at least consistent. 

I believe that language intolerance, regarding both form and content, is a major liability against freedom, democracy, and personal emancipation.

My today's list of Trump PROS AND CONS

I get a lot of heat for seeing positive signs in Trump. But I do. It's what I honestly see. I may be totally wrong. If his actual acts contradict the positive indicators after we have had time to see statistics, then I will certainly admit my error.

Why does Trump-hate have to be a religion that we all follow? (I reserve the emotions of love and hate for the people I know personally.)

I like Trump's consistent spoken messages about:

1. Wanting to get along with the emerging powers Russia and China. (link)
2. Wanting to move away from regime-change wars and globalist interventions (except to negotiate new deals to advantage the domestic economy). I like that he wants other countries to pay for NATO, because that will weaken NATO, etc.
3. Letting go of (accepting the resignation of) his anti-Iran maniac. (Trump keeps saying nonsense about Iran but hopefully reality will prevent an actual military intervention.)
4. Trashing of the CO2 nonsense and the drive for a carbon economy for the globalists. (link)
5. Constant and correct criticism of the corporate media.
6. Intention to economically and infrastructure enable the inner cities, to solve the social ills, he says. (However, this may well be just a scam...? link)
7. Disregard for political correctness. Much needed in the spiraling madness of "words that wound".
8. The fact that Washington DC hates him and all these insiders work against him.

I worry about:

a. His possible approach to Syria and Iran. But I think reality will prevent military escalation.
b. His treatment of Mexican immigration (and will it actually be worst than what Obama was doing? link).
c. What his dealings with Israel will actually be. (link)
d. His apparent lack of respect for international law! (torture, assassinations, whistle-blowers, economic sanctions, etc.) (and will it actually be worst than what Obama has done?)

But he has not actually done much yet. And good that his stupid blanket travel ban against 7 countries has been reversed by the courts.

On the increasing legal suppression of freedom of thought and expression in so-called free and democratic societies

(As evidence for increasing totalitarianism)

My main overriding message is far from new: that freedom of thought, opinion, and expression is the very basis of a fair society. That freedom of speech is the foundational individual right for a truly democratic system to exist or emerge. And that this freedom must be defended without compromise, and without bias against any particular view, no matter how distasteful or disturbing the particular view might be to some or most people.

Undemocratic powerful interests always benefit from any successful attempt to divide and conquer by censoring targeted expression. Citizens should fiercely unite around the principle of freedom of expression, and vehemently reject all constraints on form or content of individual expression (choice of words, signing, body language, tone, and images).

The message of the centrality of free expression in human societies has been strongly made by a stellar array of historical figures (Milton, Locke, Spinoza, Voltaire, Diderot, John Stuart Mill ...), and it is stated in universal covenants and declarations, but it is largely not understood or authentically accepted by a majority of societal actors. Thus, I make this added attempt to drive the point home with the following recent examples and analysis, at a time when totalitarianism is evidently making substantive forays across the Western world.

The threat against our freedoms is not from outside. Rather, it is from those who manage us. And, injustices cannot be resolved unless individuals are free to exert influence through speech. Individual influence is the primary mechanism of accountability of institutions, of private corporations, and of governments.

Only a small part of the full spectrum of increasing suppression of personal freedoms --
  • from media concentration, 
  • to editorial alignment and an absence of journalistic independence, 
  • to CIA oversight of Hollywood, 
  • to structural threats to web freedom, 
  • to copyright excesses, 
  • to pay-wall barriers against the sharing publicly-funded research, 
  • to extreme and continuous standardized testing in schools, 
  • to centralized control of school curricula without professional independence of teachers, 
  • to codes of conduct on campuses, 
  • to decreasing access to information including one's own personal information held by government, 
  • to applied intolerance of "threatening" views in every sphere of life, 
  • to legal precedents that disregard international law in freedom of speech cases, 
  • to "human rights" codes that do not require establishing actual harm against any actual victim, 
  • to increasingly constrained professional independence in all professions, 
  • to "hate speech" criminal codes that jail expressive perpetrators of victimless "crimes", 
  • to overbearing and formalized lobby-influence on politicians at every level, 
  • to the implementation of complete surveillance, 
  • to increasing incarceration rates and increasing sentences, 
  • to the militarization of police training, 
  • to global witch hunts against whistle blowers, etc.

The present article is a cursory survey of the mechanisms of select legal instruments in the current palpable increase in totalitarianism, as viewed from the perspective of direct state interference in individual thought and expression, occurring in the US and US-aligned countries, Canada in particular.

An Elaborate Edifice of Sophistry to Counter the Threat of Democracy

A society is totalitarian to the exact degree that the individual is prevented from effectually expressing his/her opinions and beliefs. Suppression of expression intended to exert influence is an accurate gauge of totalitarianism.

The elemental opposing force against runaway hierarchical dominance is the balancing force of the individual seeking freedom by attempting to exert influence. [a]

Nothing can be clearer about societal organization. The violent oppression that necessarily accompanies society's dominance hierarchy is countered only by the individual's efforts to have influence, to have a significant say in his/her own life and in the life of his/her community.

The individual, acting alone or in association with other individuals, is the essence of the protection against totalitarianism, fascism, and oligarchic plutocracy, and this is as true in the so-called "free and democratic societies" as anywhere else.

The establishment that manages the dominance hierarchy [1], uses an elaborate edifice of sophistry to artificially dissociate individual expression from the natural right to practice influence by expression. In this way, expression can be controlled where its potential influence is judged undesirable, or where it is feared to have a potential cascading effect on public perception.

Trusting that ideas can be left to be evaluated by individual citizens would be to leave the priorities of society to be decided by people. The resulting risk of popular influence is intolerable to any dominance hierarchy, by definition.

Therefore, for example, despite it being universally accepted, at least on paper and thanks to a residual sway of reason in the present era, that the right to have an opinion is absolute [2], virtually all the statutes, covenants, and legal-establishment treatises nonetheless codify that the right to express an opinion is not absolute, but rather is subject to "reasonable and necessary limits" that can be imposed by the courts that are maintained by the state. The "authorities" go on to pronounce that by imposing "reasonable limits", one achieves a "balance" between the competing interests of expression and of minimizing harm from expression, without ever acknowledging any cognitive malaise from admitting a "right" to freedom of expression while contributing to the massive legal apparatus that controls which expression can actually be free.

The elaborate edifice of sophistry, with its many arms and legs, that is used to assuage discomforts in the legal mind regarding suppression of individual expression is worthy of study and should be explicitly described. To no one's surprise, the needed study is not an exercise for which legal scholars have exhibited much enthusiasm.

The Device of Giving Institutions and Corporations Human Rights to Counter Human Rights

In one branch of the said edifice of sophistry, the court rulings expressly admit that human freedom of expression is essential to human existence and fulfillment, and "constitute[s] the foundation stone for every free and democratic society" [3], yet completely fail to discern expression of the individual from expression of multinational corporations and of powerful individuals representing institutions and nations. As a result, individual expression critical of corporations or critical of officials representing large institutions is scrutinized and carries life-changing consequences whereas mass advertizing, media control, and government propaganda are protected under a contrived umbrella of "freedom of expression", and are not constrained to prevent skewing the democratic process, undue concentrated influence, and suppression of individual freedoms.

On the one hand, there is an absolute paper-right to holding, developing, and changing one's opinion, but on the other hand there is virtually no individual recourse or protection against the dominant practice of top-down social engineering of identities, attitudes, and beliefs. The fringe counter-movements of home schooling and "going off grid" are heavily regulated and come at a high price. And there is no individual protection against employer demands for ideological conformity, especially among professional workers [4].

When a judge is tasked with "balancing" the individual's right of free expression against "reasonable limits" in a "free and democratic society", it never enters his/her legal mind that the powerful individual screeching "defamation" and whose extravagant legal costs are entirely paid by a corporation or using public money should suck it up and adjust accordingly, that the whole idea of a democracy is that there will be a cacophony of criticisms from individual citizens in addition to organized messaging and all the rest.

Instead, typically, the judge will apply the common law of defamation, which evolved to protect the sensitivities of the privileged against false rumours, and to protect the powerful against the democratizing effects of the emerging technology of the printing press, prior to the modern legal enshrinement of the universal principles of human rights.

A Tenacious and Regressive Common Law of Defamation That Is Refusing To Go Away

Even a superficial look at the tenets of the common law of defamation would be enough to make any reasonable person admit that such a structure is incompatible with finding a "balance" that justifies suppressing an individual's expression. Not so for our highest judges [5].

How is the common law of defamation incompatible with the right to free expression? It is not difficult to see, unless you are trained in law [6]:

"[Defamation] is the only common law tort (or cause of action) where damages — actual damage to reputation — and malice (malice of defamation) are assumed, and need not be proven in court. The result is a presumption of guilt — regarding falsity of the expression, malice of the defendant, and damages to the plaintiff — that can only be overturned if the defendant can prove one of the available defences, which are strictly limited and codified. ...

Defamation law is structured such that if a complained of criticism, comment, or opinion is ruled by the court to have the tendency to reduce the social reputation of the plaintiff, in the mind of a fictitious “reasonable person”, then damage to reputation is assumed and a financial award for damages is due, even in a total absence of evidence of actual damage to reputation (such as: lost fans of an artist, lost clients of a service provider, lost social connections, loss of employment, fewer invitations to social or business functions, etc.). The criticism complained of is all that is needed to obtain damages. Guilt is automatic, and the only possible defences are strictly limited and codified, carrying the names of “truth”, “privilege”, “fair comment”, and “responsible reporting”. The presumed-guilty party has the onus to prove an allowed defence."

A minority of Canadian legal scholars, the exceptions that prove the rule, have correctly argued that the presumptions of falsity, malice, and damages structurally inherent in the common law of defamation should be abolished [7].

The OCLA report adds [8]:

"All of this is exacerbated by the fact that there is no practical need for the tort of defamation because there are other common law torts that sufficiently protect against unjustified attacks to personal reputation, and which correctly require proof of harm and of malice. These include the torts of: malicious falsehood, intentional infliction of mental suffering, conspiracy to harm, and so on."

There you have it, in the face of both Canada's international obligations and Canada's own constitutional Charter, its highest court irrationally clings to a defunct common law that most-conveniently suppresses individual expression (Hill v. Church of Scientology, see Endnote-[5]). In the case in question, the Supreme Court even ruled that the fact that the plaintiff (a Crown prosecutor) had "received promotions, was elected a bencher and eventually appointed a trial judge in the General Division of the Court of Ontario" following suffering the alleged possible harm to reputation was simply not relevant in any way [9].

The Device of Attributing Diffuse and Distributed Human Rights to Remove Actual Human Rights of Individuals

Outside of applications of the common law of defamation, the highest courts are further eroding the principle of free expression, rather than moving towards recognizing it as a true right, even when the question before the court is not one of defamation.

A terrifying example has occurred recently (2013) in Canada's supreme court. The legalistic catastrophe was astutely described by social-scientist Professor Peter J. McCormick [10]. In Saskatchewan (Human Rights Commission) v. Whatcott the court somewhat diverged from its own past applications of and tentative skirmishes with the proverbial "balance", and definitively parted from the universally accepted doctrine that expression can be suppressed only to the degree shown to be necessary [11], by finding that "All rights guaranteed under the Canadian Charter of Rights and Freedoms are subject to reasonable limitations" [12], not "necessary limitations" but instead "reasonable limitations".

"Reasonable" means that the court can decide, on the basis of its subjective evaluation, what expression can "reasonably" be suppressed, rather than be burdened by the objective and evidence-based criterion of necessity. And the court did exactly that.

The court even went so far as to find that truth should not be an absolute defence against the state's suppression of an expressed statement that is both truthful and sincerely delivered, and that it can be "reasonable" to suppress such a statement in a "free and democratic society", without needing to make an objective and evidence-based evaluation of whether the suppression is necessary. There can be no substitute for the court's own words, when trying to fully appreciate the sophistry needed to achieve the goal [13]:

139. Critics find the absence of a defence of truth of particular concern, given that seeking truth is one of the strongest justifications for freedom of expression. They argue that the right to speak the truth should not be lightly restricted, and that any restriction should be seen as a serious infringement.

140. I agree with the argument that the quest for truth is an essential component of the “marketplace of ideas” which is, itself, central to a strong democracy. The search for truth is also an important part of self-fulfillment. However, I do not think it is inconsistent with these views to find that not all truthful statements must be free from restriction. Truthful statements can be interlaced with harmful ones or otherwise presented in a manner that would meet the definition of hate speech.

141. As Dickson C.J. stated in Keegstra, at p. 763, there is “very little chance that statements intended to promote hatred against an identifiable group are true, or that their vision of society will lead to a better world”. To the extent that truthful statements are used in a manner or context that exposes a vulnerable group to hatred, their use risks the same potential harmful effects on the vulnerable groups that false statements can provoke. The vulnerable group is no less worthy of protection because the publisher has succeeded in turning true statements into a hateful message. In not providing for a defence of truth, the legislature has said that even truthful statements may be expressed in language or context that exposes a vulnerable group to hatred.

142. Some interveners argued that there should be a defence of sincerely held belief. In their view, speech that is made in good faith and on the basis of the speaker’s religious beliefs should be given greater protection, or constitute an absolute defence to any prohibition. These arguments anticipate the question still to be considered of whether an infringement of s. 2(a) of the Charter by s. 14(1)(b) would be justified under a s. 1 analysis. It is sufficient here to say that if the sincerity of a religious belief would automatically preclude the finding of a contravention of s. 14(1)(b), the s. 1 analysis would be derailed with no balancing of the competing rights.

143. Apart from that concern, the fact that a person circulates a hate publication in the furtherance of a sincere religious belief goes to the question of the subjective view of the publisher, which is irrelevant to the objective application of the definition of hatred. Allowing the dissemination of hate speech to be excused by a sincerely held belief would, in effect, provide an absolute defence and would gut the prohibition of effectiveness.

This kind of extreme judicial activism towards suppression of expression, in the face of an international covenant ratified by the home state, typically occurs in cases where the issue before the court is one that opposes an unpopular minority defendant (here a religious anti-gay fanatical pamphleteer) against a strident majority view that enshrines "political correctness". In Hill v. Church of Scientology (above, and Endnotes [5] and [9]), the defendant was an unpopular religious group widely considered a "sect", directly attacked by the Crown whose legal costs were paid by the state. The action lead to the largest award of unproven "damages" ever seen, and to the above-described sophistic findings about the common law of defamation.

Occasionally, the alignment of societal-mobbing circumstances works the other way. In WIC Radio v. Simpson [14], the plaintiff was in the minority as a public critic of gay-rights content in school curricula and the defendant was a radio station and its talk-show host who had compared the plaintiff to Hitler and stated that she was personally inclined towards violent methods in advancing her campaign, none of which had any demonstrable basis in fact. In that case, Canada's supreme court made the strongest defence of the right to free speech in its post-Charter history, which gave a needed boost to the so-called "fair comment" defence in the common law of defamation, while of course preserving the above-described absurd tenets of this common law.

The Aggressive Assault of Criminalizing "Hate Speech"

The situation is even more alarming when it comes to "hate speech crime". "Free and democratic societies" such as those in Canada, France, and Germany, have "hate speech" instruments in their criminal codes. Here sophistry is barely needed. The state need only prescribe which utterances are criminal and decide which targets will be prosecuted.

"Hate speech crimes" are remarkable "crimes", in that there are no identified victims and no proven harm. Those charged can be sentences to jail, the ultimate suppression of freedom (barring execution), without the prosecutor being required to prove harm or intent to do harm or that there was a single actual victim.

The unusual features of these criminal codes do not appear to ruffle the cognitive serenity of the managers of law and order. Judges are bothered by the victimless nature of these extraordinary "crimes" as much as they are vigilant regarding the remarkable statistical coincidence that every time a frail victim of police brutality is beat to a pulp the police file charges of "assault" by the victim, which are duly prosecuted by the Crown. Smart-phone cameras and web-postings are making such a judicial blind spot more and more difficult to maintain. But with "hate crimes" the prosecutors need only find sufficiently unpopular targets to make burn-at-the-stake examples that serve the state propaganda for war or whatever campaign of international exploitation.

"Hate crime" codes are intrinsically political, and are a direct affront against human rights. In Canada, a "hate crime" can only be prosecuted with the explicit and statutory permission of the government (Attorney General) [15].

The criminal-code excesses that are increasingly present in Canada were foreseen by international law, thanks to excesses observed in "less democratic" states. For example [16]:

States parties should ensure that counter-terrorism measures are compatible with paragraph 3. Such offences as “encouragement of terrorism” and “extremist activity” as well as offences of “praising”, “glorifying”, or “justifying” terrorism, should be clearly defined to ensure that they do not lead to unnecessary or disproportionate interference with freedom of expression.

Laws that penalize the expression of opinions about historical facts are incompatible with the obligations that the Covenant imposes on States parties in relation to the respect for freedom of opinion and expression.116 The Covenant does not permit general prohibition of expressions of an erroneous opinion or an incorrect interpretation of past events. Restrictions on the right of freedom of opinion should never be imposed and, with regard to freedom of expression, they should not go beyond what is permitted in paragraph 3 or required under article 20. 

The modern practice in Canada, France, and Germany towards explicitly making so-called "holocaust denial" a crime punishable by incarceration is a shocking testament to stupidity and to a crass special-interest fetish tied to geopolitical projects. It appears to be too much to ask that law makers actually read the unassailable academic work of Professor Norman Finkelstein on the question of the exploitation of the Nazi holocaust by powerful special interests [17], which was endorsed by the world's preeminent scholar of the Nazi holocaust, Professor Raul Hilberg [18], before the said law makers vote for such embarrassingly stupid laws. 

If Canada cared about historical genocides, it could respect its treaty obligations and pay reparations arising from its own most-efficient genocide of native peoples, the persistent consequences of which are repeatedly documented in United Nations reports. Likewise, France could pay due reparations to Haiti, for a start. All of this can be done without violating free expression rights. Instead, these "free and democratic societies" pass criminal codes that would, on their letter, put both Norman Finkelstein and Raul Hilberg (if he was not already dead) in jail for, among other things, publicly contradicting or criticizing the dogma of the "6 million deaths" figure. Unbelievable. You could not make this up.

Freedom Is Better

All of these legal instruments of intimidation against free expression (political correctness codes, defamation law, and hate-speech criminal codes) represent massive systemic repression against individuals, both directly and psychologically. The resulting harm to human development, the resulting quashing of societal creativity, and the resulting damage to the human spirit are impossible to imagine qualitatively, let alone gauge in magnitude. As a result of the overall regime of thought control, codified by these legal instruments against free expression, we are individually stunted and made capable of participating in horrendous crimes of state, including hugely asymmetric wars of aggression and wholesale destruction of distant nations.

The opposite is liberty. In an actual free society, expressed ideas -- no matter how insulting or insensitive or perceived-as-threatening to our values and identities -- are debated, ignored, developed, forgotten, recorded, reacted to, rejected, embraced, or whatever, but expression itself is never suppressed at the source; because the source is a human being, and one's emotional reaction belongs to the person having that reaction, who in turn also has a right to freedom of speech.

For example, evolution-theory is threatening to the identity and beliefs of many people. Therefore, should it be criminalized? Likewise, creationism is threatening to the beliefs and world views of many people. Therefore, should it be criminalized, suppressed with fines, or not allowed in schools? Homosexuality is threatening to the beliefs and identities of many people. Therefore, should expression about homosexuality be banned? Should the gay reality of society be celebrated and taught in schools, or should it be forbidden talk in the classroom?

If what is taught in school is received uncritically by children, then the problem is not what is taught, but rather school and parents themselves. In a free society, children and adults are not so gullible because they constantly practice speech and are subjected to different opinions, and therefore think for themselves about things that matter to them. In a free society, children bring much of the curriculum with them into the classroom, and parents are allowed into that sacred place. Fights over the content of the indoctrination material, whether the material is from the dominant paradigms or from opposing paradigms, are largely fights over the kind of zombie one hopes to create.

The thinking person is not afraid of expressed opinions and does not waste time arguing about form rather than meaning. The independent thinker does not need others to be gagged and punished for their opinions, or for the manner in which those opinions are expressed. The listener's loss of interest and the loss of engagement are punishments enough for the communicator, in a healthy society.

The state instruments of suppression of speech erode human relations, impoverish the human experience, and deprive us of individual influence and political engagement. We have a natural right to speak and to hear others speak. No entity has a legitimate right to silence individuals. The damage done by the legal instruments of suppression of speech is immeasurable.

Just trying to attract attention?


Our personal psychology is largely determined by the fact that we are born into a hierarchy.

What does it mean when an agitator, a gadfly, is told "you are just trying to attract attention to yourself"?

Think about it. The whole idea of having influence in society is premised on being recognized. The whole idea of increasing one's influence is to be more recognized.

The entire political dimension of the person is the possibility of practicing one's influence on the community and on society at large.

Why else does the artist art? Why does the worker work if it is not to meaningfully contribute? Agency over one's life and opportunity to influence community (including the workplace!) are the basis of a meaningful life.

But a hierarchy will have none of it. You must be dedicated to preserving the hierarchy and your place within the hierarchy. The cardinal rules in a hierarchy are know your place, keep or improve your place, and kiss ass.

In light of who says it and why, in light of how the agitator is disturbing to others, I think it is clear:

"He/she is just trying to attract attention."

means

"He/she does not know his/her place."

... is not following convention, is not following the rules, is disregarding taboos, is not making valid and central points, is not disturbing us, is not having an influence, should not be taken seriously, etc.

The "you are just trying to attract attention to yourself" is hierarchy maintenance talk meant to neutralize the threat; by appeal to the pathological notion of self-sacrifice in service and obedience to a human hierarchy.

In using hierarchy against itself, it is a viable tactic to do it publicly in order to protect oneself with visibility. In disturbing the psychological reinforcements of hierarchy, one has to expect a hierarchy-preserving backlash.

Sustained disruption can create the circumstances wherein foundational criticism can be received. It's the only thing that ever does.

Murder and genocide are natural, therefore rebel!

A socio-biological critique of First-World middleclass activism

Evolution can be societal. Here I argue that we must recognize our primal drive for murder and genocide and society’s propensity for violently oppressive hierarchies in order to react with the needed determined and sustained individual-based rebellion. This rebellion is against the rogue warlords and hierarchies that dominate us. Warring and its hierarchical support serve no useful purpose now that the human species is not ecologically threatened by natural competitors and now that there is no need for genetic selection (otherwise imposed on a small gene pool by an unforgiving natural environment).

This is a critique of First-World middleclass activism, in the hope that it will start contributing to human evolution.

I argue that laws and ethical systems are diversions that serve hierarchy and I argue that a victim mentality induced by hierarchy makes us susceptible to the appeal of canned justice and to various escapes into cowardice; rather than allowing us to perceive the otherwise obvious possibility of rebellion and self-defence.

I describe a positive feedback trap in which perturbed activists respond to perceived threats by launching into behavioural rule generation (an anxious quest for the perfect model) which in turn supports the system causing the threats. This leads to off-target and co-opted actions such as ineffective appeals to politicians, lobbying for new laws and regulations, adopting extreme personal lifestyle rules, and extremes in applied political correctness (“inclusive language,” “safe space,” etc.). The more the activists feel threatened the more they spin pseudo-comforting behavioural rules and make requests to the hierarchical oppressors for better rules, thereby increasing their societal isolation and further distancing themselves from effective means.

The gargantuan failures of First-World middleclass activism in the face of advancing soul-battering corporate fascism, murderous militarism and exploitive finance globalization since the 1970s should be cause for radical self-examination. Canadian queer pride parades (that can’t agree on whether Israel is an apartheid sate), reparationless apologies for aboriginal residential schools, zero-impact demonstrations and petitions, and tolerated and disappeared public musings about proportional representation and parliamentary free votes just don’t cut it; whereas corporate greening counts negatively. It’s like the activism was designed to fail. There is little sign of actual resistance from the First-World middleclass.

MURDER IS NATURAL AND HEALTHY IS SICK

Animal rights activists believe that abstaining from killing animals is a higher moral state to which humans should aspire. But is it helpful and productive to aspire to a state that is not natural?

On the other hand, some animal rights activists internally accentuate the murderous ways of humans and react by acting externally on behalf of other species to concretely oppose the killing. These resistors, such as members of the Animal Liberation Front, are among the boldest and most effective direct action First-World activists around. They act in true solidarity with the animals with which they identify. [1]

Most other First-World activists prefer to believe that humankind has a natural tendency towards cooperation and altruism that can flourish given a sufficiently humane system such as socialism or communism or constrained capitalism infused with more participatory decision making, and so on. [2]

But is it helpful and productive to aspire to a state that is not natural? And is it not harmful to be deceptive about one’s nature rather than practice honest self-appraisal? [3]

Should we not first ask whether or not humans have a natural tendency to practice murder and genocide? After all, genocides are far more common than the Israel lobby would have us believe. [4][5]

Certainly the spider, with its complex behaviour in hunting, stalking, and ambushing prey, is a sentient being. Presumably the spider could not survive on tomatoes and grass. The spider thrives on killing and devouring (alive) other sentient beings (including birds and small mammals when circumstances permit). Is it immoral for the spider to practice this behaviour? Has evolution privileged humane killing methods in the spider?

What about the killer whale? Is it not often observed to play with its prey for hours before killing it or simply letting it escape? We’ve all seen the documentary films where a live seal is repeatedly thrown like a rag doll; and the monkeys who torture a captured bird before eating it, or not.

Among large apes, dominant males maintain harems and violently prevent most other males from reproducing, while expecting complete submission and sexual favours from the females. They kill offspring that are not their own.

We know that birds mob individuals from their flocks and kill the undesirables for no apparent reason related to flock survival. And we know that human groups also practice mobbing.

If something is natural can it be wrong? Would it not produce healthier societies to recognize what is natural human behaviour and to make practical decisions based on realistically evaluated primal impulses rather than mask it all with moralistic rituals and myths?

We determine that an animal behaviour is natural by correctly supposing that animals left to themselves exhibit their natural behaviours. We can supplement this by physiological arguments. For example, we know that carnivores do better when they eat meat and that herbivores do better when they eat grass.

Let us apply the same rules to humans. Throughout history and as far as we can deduce, humans have predominantly been omnivorous and competitive for territory, resources, and reproductive projection. Clans have killed clans. Families have feuded. Patriarchies have maintained themselves. Nations have invaded other nations and taken slaves and resources at will. Entire peoples have been exterminated or enslaved every time superior war technology or tactics have been developed. The present is not excluded.

Human history is a story of human carnage. Is this not the first truth about humankind? Stable societies established by military strength are characterized by slavery, serfdom, kingdoms, prisons, mental institutions and every form of domination and exploitation; now including globalized wage slavery and resource expropriation.

On this backdrop, are philosophical discussions about morals and justice mere camouflage and deception only intended for temporary and superficial relief from reality? Or do they have another utility?

Canadian society’s crimes include, a continuing genocide against aboriginal peoples [5], a geopolitical war in Afghanistan, support for the US Empire, support for the genocidal and apartheid state policies of Israel [6], overturning the democratic popular government in Haiti, corporate and finance predation throughout the world, an immoral prison system used to maintain social inequities [7], vast structural social inequities with mass public health consequences, mass civil rights violations perpetrated at will and without consequences for the decision makers (e.g., G20-Toronto), mass indoctrination and pacification of the youth [8], continual social engineering manipulation, universal pharmaceutical and medical establishment predation [9] and much more.

And as I write this there is a cultural and racial global war of dominance raging. Geopolitical alliances are defining boundaries and leveraging control of energy resources. Enemies are formed in the ape minds of our leaders who distribute territory and privilege to their ape friends.

All of this appears thrust upon us by the natural world where predator species fight for territory and dominance. Don’t ask the lions to get along with the hyenas. A balance of forces is the only justice. The only thing keeping a dominant male from killing another male’s offspring is the birthing female’s teeth and wits.

THE POINT OF THE LAW

Is it not therefore somewhat artificial for humans to administer a “justice” system in form as though it related to justice and to criminalize murder as though it was some kind of unnatural anomaly? Is it not a rather cynical farce in our societal politics of the killing machine to talk about God and to pay lip service to morals and to ethics?

Or do laws and ethical systems play an essential role in justifying some murder and exploitation (war, economic predation) while providing some restraints at home? Such as: Father can go out into the world to steal, exploit and murder but it says he can’t just kill his dependent wife and children when he gets tired of them.

Or in our hierarchies are laws and ethical systems meant to keep the masses in their place with a false sense of security; an understanding between masters and slaves? The slaves provide servitude in exchange for the promise of safety. They demand to be exploited fairly. They are conned to accept punishment as “justice”.

In view of the above, laws and ethical systems appear to serve complimentary functions:
● They provide enforceable mechanisms to facilitate monopoly building by the top corporate and finance predators.

● They provide enforceable structure and codifications to preserve and strengthen the hierarchy.

● They codify the impotence of hierarchical underlings and define the place of underlings.

● They create an illusion of needed master-provided safety to underlings, in exchange for required compliance and servitude.

● They create the double standard whereby strict penalties for harming or attacking the hierarchical masters are enforced while killing in the service of the masters (military, police, accountants, etc.) is legitimized.
The Ten Commandments appear to be primarily concerned with nuclear family patriarchy as a basis for society. The Geneva Conventions deal with the rules of war between nation states, thereby legitimizing both war and nation states. And so on.

We invent morals and ethics to codify servitude and to establish dominance. We develop and maintain these codes and we come to believe that they are natural and that they provide security in themselves.

As war and exploitation technologies and social systems progress and as hierarchies grow and collide, so-called civil society and the diplomats, law makers and regulators follow explicit and unspoken directives in spinning more and better overarching webs of behavioural codification, in the hope of protecting us all while in fact entangling us more securely into the killing machines that we inhabit.

These codes, like all laws, are delimited and defined by power – they must be or they would not serve the acting hierarchies. All resource-intensive political endeavours in a hierarchy must serve the hierarchy.

It is not surprising that organized religions have been used to justify a majority of the most horrendous wars. This is a primary political function of religions, to expand the hierarchy. You have to admire some Jews for their honesty and transparency in this regard [18].

It is also not surprising and not operationally contradictory that organized religions are used to manage the home front. This is also a primary political function of religions, to maintain the hierarchy. It is natural for organized religion to collaborate with nationalism and to support corporate fascism; such as with the Nazi holocaust and now with US fundamentalist “Christian” support for the apartheid state of Israel – America’s military cash cow and thug in the Middle East.

POSITIVE FEEDBACK LOOP, DOWNWARD SPIRAL

In a bad habit gone mental, the more underlings and progressives feel threatened by hierarchies that have tapped into humanity’s murderous tendency the more desperately they strive for “better” laws, rules, and ethical codes; the more they seek to strengthen the very hierarchies that feed on us all.

Instead of finding the strength within, the warrior instinct that would fend off competing predators, hierarchical underlings beg for a more just master and expect a process that they do not control to wield a better world.

A now classic example is how the green movement was co-opted by atmospheric CO2 euphoria in which corporate leaders, First-World governments, global financiers, mainstream media, the NOG sector, the service scientists, and environmentalists all aligned to defeat a mythical carbon threat by advancing the largest planetary finance scam and economic development policing code ever conceived, thereby solidifying planetary social injustice in the name of social justice. [9][10][11][12]

And there is no lack of other examples. The entire apparatus of government is dedicated to spinning laws and regulations that provide more control to power and a continually renewed illusion of justice-from-rules to those underlings fortunate enough to have the luxury of illusions.

There have been times when governments and laws served to partly counter corporate fascism but these times were episodes during which underlings did find strength within to force some concessions from power. The resulting resistance regulations, laws and rulings have had short half-lives in a social environment of servitude and were quickly replaced and degraded. For example, how long did it take since the 1970s for health and safety government regulators to become corporate whores? [13] How long did it take in Canada since the 1970s for somewhat student-centered public education to become mind-numbing obedience training? [8]

Now in victim mode, the greater the perceived threat to we privileged middleclass hierarchical underlings, the more frantically we spin and scream, the more diligently we appeal to the humanity of our “representatives”, the harder we work to establish sane alternatives and “safe spaces”, to escape impending disaster.

INCLUSIVE LANGUAGE AS SICKO

I see many alternative networks, pathological desires to be isolated in “like mindedness” and extreme expressions of political correctness all around, as ineffective victim-mindset escapes from and shields against a violent and increasingly oppressive hierarchy.

As a consequence of this perceive-threat/spin-rules positive feedback trap, many of the resulting socio-behavioural escapes can be extreme. Veganism is often originally such a reaction towards an extreme rule-based behaviour, one which is contrary to natural consumption opportunism. There are no economic-underclass vegans in the First World. Other extreme lifestyle rule systems include physical activity ritualism, carbon footprint reduction obsession, off grid fetishism, etc. When extreme, these reactions can be all-consuming and can determine relationships and fundamental beliefs.

For example, how crazy is a frazzled clique of middleclass First-Worlders that develops and maintains an elaborate social behaviour code centered on “sensitivity/anti-oppression training” emphasizing the enforcement of “inclusive language” and the criminalization of racist expression as “hate speech” while not effectively and directly resisting the very hierarchical structure that so causes it to behaviourally suppress reality rather than physically confront its own immediate oppressors? This latest political correctness extreme social reaction is post-advent of nineteenth century anarchism and is therefore retarded. Academic feminist theorists have done little to stop this sad and regressive phenomenon.

Even one fully escape-integrated progressive academic [14] has critiqued these peaking political correctness excesses as having gone too far. [15]

CONCLUSION

A more healthy and self-respecting activism would be to recognize humankind’s primal capacity and impulse for invasion and murder and human society’s propensity for violent hierarchical oppression and to react in self-defence rather than to escape into isolation and pathology or to grope subserviently for power’s protection.

Self-respecting activists and anarchists and libertarians worthy of these titles need to practice day to day distributed rebellion as the only defence against our rogue killer-warrior masters who insist on running prison and extermination camps rather than serving as protectors only when needed. The species is no longer at risk from the outside. It’s time for a biological reality check and a vigorous and persistent program to keep these thugs in line.

There is no “then what?” Murder and genocide will stay alive and hierarchy will always tend to broaden its scope and sharpen its control. Rebellion (direct participation, resistance, sabotage, personal influence, taking back control, having a direct say) is the antidote to hierarchical violence and oppression. Rebellion creates a real and evolving alternative. Our constant rebellion is also our liberation, growth, and connection. Rebellion is anchored in the individual fighting his/her own oppression at the point of strongest individual contact with the control hierarchy – at work, at school, on the street, in the prison, on the reserve; wherever the individual is controlled in his/her own life. [2][3][16][17]

Allow me to develop a little more: Disallowing the word "pig(s)" in describing cops as agents of repressive state power, a perfectly good word with a rich cultural history, protects the cops and harms the oppressed. This is done in the name of an "anti-oppression mandate" in a classic pathology that Ward Churchill called "pacifism as pathology" when he argued that this pathology of left progressive activists was deeply racist.
